The silver age Captain Marvel first appeared in issue #12. This Captain Marvel is a different character from the original Captain Marvel (who gained his super-powers when he uttered the word Shazam). That character is currently owned by DC comics which owns the rights to that character. But Marvel owns the rights to use the name Captain Marvel as a comic book title and has the right to create a different character with the same name. How is this possible? Go ask the lawyers. Later, this title reprinted early issues of Daredevil (1964 series) and Iron Man (1968 series). After that, this title reprinted Sub-Mariner and Hulk stories from "Tales to Astonish (1959 series)".
